Notice of Special Meeting of Members re Withdrawing from IURC

TO THE MEMBERS OF MARYSVILLE-OTISCO-NABB WATER CORPORATION AND THE SECRETARY OF THE INDIANA UTILITY REGULATORY COMMISSION


In Re: Notice of Special Meeting of Members re Withdrawing from IURC Jurisdiction


The purpose of this letter is to provide you with written notice that the Board of Directors of the Marysville-Otisco-Nabb Water Corporation (“MON Water”) have decided to hold a special meeting of the members for the purpose of discussing and holding a vote on MON Water withdrawing from the jurisdiction of the Indiana Utility Regulatory Commission (the “IURC”). This special meeting is scheduled from 5 p.m. to 7 p.m. on Thursday February 27, 2025 at Community Tabernacle at Fellowship Hall, 108 E. Chestnut Street, Otisco, Indiana 47163.


The IURC is the Indiana state government agency that regulates a utility’s (such as MON Water’s) rates and charges, their ability to borrow money, and their rules and policies. The Indiana Code allows a utility such as MON Water the ability to “opt out” of the IURC for more local control.


Each member of MON Water is entitled to cast one (1) vote on the question of whether MON Water should withdraw from IURC jurisdiction and may vote either in person at this special meeting or by absentee ballot. Only one (1) vote is permitted per household and a person or entity that is a member may only vote once despite owning more than one (1) property. Please note that proxy voting is not permitted. If a majority of members that vote cast their ballots in favor of MON Water withdrawing from IURC jurisdiction, then the withdrawal becomes effective thirty (30) days after the date of the vote. A quorum consisting of not less than five percent (5%) of the members must: (1) be present at the meeting; or (2) vote by absentee ballot; in order for the members of MON Water to take official action regarding this jurisdiction question.


A member may vote by secret absentee ballot in place of voting during this special meeting. Requests for an absentee ballot may be made by calling the MON Water office (812-256-6378), emailing the MON Water office ([email protected]), or stopping in the office (7703 Hwy 3, Marysville, Indiana 47141) during regular business hours, which are from 8:30 a.m.-4:00 p.m. Monday through Friday. Only members of MON Water may request and fill out an absentee ballot. Please note that a request for an absentee ballot precludes a member from voting in person at this special meeting. A member voting by absentee ballot must deliver the absentee ballot in person to the offices of MON Water during MON Water’s regular business hours for such vote to be counted. This is the only permitted method of returning an absentee ballot.


Voting by absentee ballot will be available beginning at 8:30 a.m. on Monday February 17, 2025 until 4:00 p.m. on Friday February 21, 2025. An absentee ballot will be considered received by MON Water upon delivery to the MON Water office during regular business hours and only during that time frame.
